Apple in hot water over development tools

According to a New York Post article Apple is in hot water over the tools developers must use in order to have their applications on the iPhone and iPad, The FTC and the DOJ are taking time to launche a formal inquiry about the 3.3.1 clause on the developer agreement.
Apple needs developers to use Apple’s tools to develop applications for Apple’s devices…. I don’t see anything so strange here, but authorities will let Apple knows what is right or wrong and Steve will be more than happy to demonstrate his cause to a higher audience while Adobe is jumping around of joy and happiness.
